General Terms and Conditions (GTC)
for the brokering of stallion semen by the company Vornholt Pferde
(As of: January 2026)
1. Scope
(1) These General Terms and Conditions apply to all contracts between Vornholt Pferde, owner Steffen Vornholt, Zum Flatt 6a, D- 27374 Visselhövede (hereinafter referred to as "Agent") and the customers (hereinafter referred to as "Customer") regarding the brokering of stallion semen.
(2) For the purposes of these terms and conditions, customers are both consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB).
2. Subject matter of the contract
(1) The intermediary arranges the delivery of chilled or frozen semen (semen doses) on behalf of stallion owners or insemination stations.
(2) The intermediary does not act as the stallion owner or proprietor of the stallion, but rather as an intermediary between the stallion owner and the customer. The semen is stored at the respective insemination station, both domestically and internationally, and is sent directly from the insemination station to the customer's specified delivery address.
(3) Actual fertilization, pregnancy or birth is not part of the contract and cannot be guaranteed by the intermediary.
3. Conclusion of contract
(1) The information on stallions and semen portions presented on the website, in catalogues or in other publications does not constitute a binding offer, but a non-binding invitation to place an order.
(2) A contract shall only be concluded when the intermediary confirms the customer’s order in writing or electronically.
4. Prices and Payment
(1) All prices are in euros (€), excluding statutory VAT of the respective country, unless otherwise stated.
(2) Payment shall be made upon invoicing by the stallion owner or the insemination station or as otherwise agreed.
5. Delivery and Shipping
(1) Delivery shall be made by approved shipping services or animal transport companies that comply with the requirements of EU Regulation (EU) 2016/429 (Animal Health Law).
(2) Delivery times depend on availability and will be communicated to the customer in good time.
(3) The shipment of sperm is at the customer's risk once the shipment has been handed over to the transport service (§ 447 BGB).
6. Semen composition
(1) The characteristics are determined by the information provided by the stallion owner (e.g. quality, date of harvest, fertilization rate).
(2) The intermediary assumes no guarantee or liability for fertility or pregnancy.
(3) Veterinary examinations, artificial insemination and pregnancy checks are the responsibility of the customer and his veterinarian.
7. Liability
(1) The intermediary shall be liable without limitation in cases of intent and gross negligence as well as in cases of injury to life, body or health.
(2) In cases of slight negligence, the intermediary shall only be liable for breaches of essential contractual obligations (cardinal obligations), limited to the typically foreseeable damage.
(3) Liability for consequential damages, in particular lost profits, incorrect or undelivered goods, incorrect covering or non-impairment, is excluded.
8. Warranty
(1) Warranty claims are governed exclusively by the contractually agreed quality.
(2) Natural variations, temperature fluctuations or shipping conditions which are outside the control of the intermediary shall not constitute a defect.
9. Withdrawal / Cancellation
(1) An order can only be cancelled before shipment.
(2) Once dispatched or removed, returns are excluded for hygienic and veterinary reasons.
10. Data protection
Personal data is processed in accordance with the privacy policy of Vornholt Pferde, available at [Link to privacy policy].
Data will only be passed on to third parties (e.g. stallion owners, veterinarians, shipping service providers) insofar as this is necessary for the processing of the contract.
11. Jurisdiction and applicable law
(1) German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If the customer is an entrepreneur, the place of jurisdiction shall be the place of business of the intermediary.
(3) The statutory rules of jurisdiction apply to consumers.
12. Severability Clause
Should individual provisions of these terms and conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
