Terms and Conditions of Sale
Terms and conditions for seed orders (General Terms and Conditions):
1. Please always check seed availability by phone.
2. The breeding season runs from February 1st to August 31st of each year; semen orders must be placed in writing via the online order form from Monday to Saturday.
Shipping is possible Monday to Saturday and only takes place after full payment has been received.
Delivery usually takes place the next day; weekend deliveries incur a surcharge. Please inquire at the office for exact shipping costs.
3. For foreign customers, I charge €75.00 per delivery for processing and issuing the veterinary certificate (Traces paper) and a flat rate of €150.00 per delivery for filling the shipping container with liquid nitrogen, including the rental fee, plus VAT and shipping costs.
4. The stated stud fees are subject to 7% VAT and must be paid before the first semen shipment. Invoices will be sent by email and are due immediately. I reserve the right to refuse semen shipment if invoices are not paid in full, if there has been a history of late payment, or if shipping containers have not been returned on time. Shipping costs will be billed directly to the customer by the shipping company.
5. A barren mare can only be considered as such if a veterinary certificate of non-pregnancy is available.
6. I have had the stallions tested for WFFS (FFS) during fresh semen insemination; the results can be found in each stallion's description. If you use a stallion that is WFFS positive, Vornholt Pferde will cover the laboratory costs for testing your mare. The amount will be credited to your stud fee invoice and will not be paid out. This applies only to stallion semen stored in Visselhövede, for which I hold the exclusive distribution rights.
7. Due to the recent changes to the performance test regulations, I would like to remind our breeders that the use of stallions for breeding before they have completed the sport tests or the short test/50-day test, and before achieving the required sporting results, is at the breeder's own risk. Stallion owners will endeavor to obtain the necessary performance records, but cannot guarantee them.
8. Please also note that registration of foals sired by stallions licensed abroad is not possible with every breeding association; in some cases, the breeder may need to apply for permission. Please clarify this with your breeding association beforehand.
9. Please inquire at my office about the specific conditions and prices for frozen semen. Frozen semen is intended solely for use in artificial insemination. Use of the semen for, e.g., embryo transfer or ICSI/OPU is possible after registration and requires my written consent. For animal welfare reasons, frozen semen may only be supplied to recognized insemination centers and veterinarians. Transferring frozen semen to third parties is prohibited. Dividing insemination doses is not permitted. Only one breeding certificate will be issued per dose sold. Breeding certificates are issued exclusively by me. Violations will be prosecuted. The resale of frozen semen is prohibited.
10. To prevent the illegal semen trade, I expressly point out that the breeder/purchaser only acquires the right to use the semen upon payment of the stud fee, and not ownership of it. Violations will be prosecuted. Unused and used semen straws must be returned free of charge.
11. Semen shipments abroad are only possible upon prepayment of the full stud fee plus shipping costs and the cost of the TRACES documents. I reserve the right to invoice any additional costs incurred for semen shipments.
12. I have several TG shipping containers, but I would like to ask our customers to send us their own containers for transport, as we cannot guarantee availability. TG shipping is only available with prepayment of shipping costs for both the outbound and return shipments. We have also now equipped our shipping containers with GPS trackers to monitor their location.
13. Use of frozen semen is at the breeder's/customer's own risk. No claims or compensation can be made against Vornholt Horses or the stallion owners. The received frozen semen is to be used only for the specified mare in normal insemination. Resale/transfer is prohibited, as is embryo transfer/ICSI/OPU, and violations will be prosecuted. Used and unused straws must be returned. A contractual penalty of €2,500.00 will be due in the event of unauthorized use or transfer.
14. Stallions used for breeding from other breeding associations will only be partially registered with their original breeding associations. Breeders should expect higher fees in these associations. Information can be obtained from the respective associations.
15. Liability for transport damage is excluded. Please report any complaints in writing to the office immediately on the day of delivery. Otherwise, the transport will be invoiced. After insemination, the signed semen shipment confirmations must be returned to the station with sufficient postage in the shipping containers. Otherwise, these will be invoiced.
16. We are all human and mistakes can happen, so please check your semen deliveries. If you do not receive the correct semen, please inform me immediately by phone and also in writing via email to samendepot@vornholt-pferde.de. If we do not receive notification, later claims are excluded. The semen user, i.e., the veterinarian or inseminator, must check the delivery before insemination, specifically the labeling of the semen tubes and the accompanying semen papers, and consult with the breeder if necessary. If the semen user nevertheless uses the potentially incorrect semen, they are solely liable for any resulting damages. All semen doses (fresh or frozen) are labeled with the stallion's name, life number, date of production, station name, and registration number. Should anything be incorrect, please do not hesitate to inform us and inquire before use.
17. A contractual penalty of €2,500.00 will be due if the breeder / customer violates the terms and conditions, fails to pay invoices or does not return shipping containers.
18. The stud certificate will only be issued and forwarded to the respective breeding association once the stud fee invoice has been paid in full and all other incurred costs (veterinarian, stable fees, shipping, etc.) have been settled.
